Legal Advisor – Tabasco Human Capital

Job Purpose

As a Legal Advisor in our manpower solutions firm, you will oversee and manage all legal matters relating to our operations. You will be responsible for ensuring strict compliance with local and international labor laws, drafting and reviewing complex commercial and employment contracts, and mitigating legal risks associated with contingent staffing, permanent placement, and global mobility. You will act as the key legal advisor to senior management and operational teams.

Key Responsibilities

Contract Management: Draft, review, negotiate, and manage master service agreements (MSAs), service level agreements (SLAs), client vendor agreements, and candidate employment contracts.

Labor & Employment Law Compliance: Monitor, interpret, and ensure company compliance with changing labor laws, immigration regulations, and employment standards across all regions of operation.

Credit Risk & Onboarding Management: Review and approve credit terms for new clients during the onboarding phase, ensuring contract clauses regarding late payment penalties, interest, and collection fees are robust and enforceable.

Legal Collections & Debt Recovery: Oversee the legal strategy for outstanding accounts receivable (AR); draft and issue formal demand letters, legal notices, and statutory warnings to non-paying clients.

Risk Management: Identify potential legal risks in business operations, client partnerships, and recruitment processes, providing proactive strategies to mitigate them.

Dispute Resolution & Litigation: Manage employee grievances, labor disputes, contract breaches, and client conflicts. Coordinate with external legal counsel when litigation is required.

Dispute Evaluation : Analyze disputed invoices (e.g., disagreements over candidate placement fees, temp hours billed, or contract terms) and provide legal assessments on the probability of recovery versus litigation costs.

Corporate Governance : Ensure the company maintains all necessary recruitment licenses, corporate registrations, and statutory compliance certificates.

Settlement Negotiations: Lead negotiations for debt settlement agreements, payment structures, and restructuring plans with delinquent clients to secure company revenue while avoiding prolonged court battles.

Internal Advisory : Provide clear, business-oriented legal advice to leadership, HR, and sales teams on complex recruitment scenarios, background screening, data privacy (e.g., GDPR), and worker classification (e.g., independent contractors vs. full-time employees).

Policy Development: Formulate and update internal company policies, codes of conduct, and compliance frameworks to match evolving legal standards.

Requirements & Qualifications

  • Education: Bachelor of Laws (LLB) or Master of Laws (LLM) from a recognized university.
  • Experience: Minimum of 5-8 years of corporate legal experience, with at least 2-3 years specializing in labor law, employment law, or the staffing/recruitment industry.
